Nuvcreatives Service Terms

These Service Terms apply to projects and services purchased from Nuvcreatives. By approving a project, accepting these terms at checkout, submitting payment, or otherwise authorizing Nuvcreatives to begin work, the client agrees to the applicable project scope, payment terms, responsibilities, timelines, and policies outlined below.

1. Project Scope

Each engagement is limited to the service, deliverables, priorities, and scope confirmed by Nuvcreatives before work begins.

The agreed scope may be confirmed through the application, email correspondence, project summary, invoice, Stripe payment page, onboarding materials, or other written communication from Nuvcreatives.

Requests outside the approved scope may require an additional fee, additional project day, revised timeline, or separate engagement.

2. Services

Nuvcreatives services may include, depending on the purchased engagement:

  • Custom Brand Identity
  • Brand + Website
  • VIP Creative Day
  • Brand + Website Audit
  • AI Business Solutions
  • Other approved creative, branding, website, marketing, digital, or strategic services

The specific service purchased by the client determines the applicable deliverables and project process.

3. Payments and Deposits

The payment amount, deposit requirement, installment schedule, or full-payment requirement will be stated before purchase or on the applicable Stripe checkout, payment link, invoice, or written project confirmation.

Payment is required according to the agreed payment schedule before the applicable work begins.

Project dates are not considered fully secured until any required payment has been received.

Late or incomplete payments may delay project work, delivery, launch, or handoff.

Unless otherwise agreed in writing, payments apply only to the approved project scope.

4. Client Responsibilities

The client is responsible for providing the information, content, feedback, files, approvals, credentials, access, imagery, copy, and other materials reasonably required to complete the project.

The client agrees to:

  • provide accurate and complete project information
  • provide required materials by agreed deadlines
  • respond to review and approval requests promptly
  • provide consolidated feedback
  • confirm that submitted materials may legally be used
  • maintain access to third-party platforms required for the project
  • review final work before launch or approval

Delays in client-provided materials, feedback, approvals, access, or decisions may affect the project timeline.

5. Timelines

Project timelines begin only after required payment, onboarding information, project materials, and required access have been received.

Estimated timelines are based on the scope and information available at the beginning of the project.

Client delays, additional requests, third-party platform issues, technical limitations, or approved scope changes may require the timeline to be adjusted.

Nuvcreatives will communicate material timeline changes when reasonably possible.

6. Revisions and Feedback

Revision limits depend on the purchased service and confirmed project scope.

Revisions are intended to refine the approved creative direction or deliverable, not create an entirely new project scope.

Feedback should be consolidated and submitted through the requested review process.

Additional revision rounds, major direction changes, new deliverables, or requests outside the agreed scope may require additional fees.

7. VIP Creative Day

VIP Creative Day is a reserved creative workday for one clearly defined priority or a tightly related set of priorities approved before the scheduled day.

The client must provide required materials, content, access, and decisions before the reserved workday.

Completion depends on the approved scope, complexity, client responsiveness, and available project time.

Work that exceeds the reserved day may require an additional VIP Creative Day or another Nuvcreatives service.

8. Cancellations and Rescheduling

Because project time may be reserved specifically for the client, cancellations and rescheduling requests should be submitted as early as possible.

Approved rescheduling may be subject to availability.

Nuvcreatives may establish service-specific cancellation, rescheduling, deposit, or booking policies when reserving project dates.

Any service-specific policy communicated before payment will apply to that engagement.

9. Refunds

Payments compensate Nuvcreatives for reserved project capacity, preparation, strategy, creative work, and services performed.

Refund eligibility, if any, depends on the specific service, project status, work already completed, and any written terms provided before purchase.

Nothing in these terms limits rights that cannot legally be waived under applicable law.

10. Scope Changes and Additional Work

If the client requests work outside the approved scope, Nuvcreatives may:

  • provide an additional estimate
  • recommend another service
  • extend the timeline
  • schedule an additional project day
  • issue a separate invoice or payment request

Additional work will not automatically be included in the original project fee.

11. Intellectual Property and Ownership

Upon full payment, the client receives the rights to the approved final deliverables specifically created for the client, subject to any third-party licenses or restrictions.

Nuvcreatives retains ownership of:

  • internal processes
  • systems
  • templates
  • reusable frameworks
  • working files not included in the final delivery
  • unused concepts
  • rejected directions
  • internal strategy materials
  • proprietary methods and intellectual property

Third-party fonts, photography, software, plugins, templates, platforms, stock assets, AI services, and licensed materials remain subject to their respective licensing terms.

12. Portfolio and Promotional Use

Unless otherwise agreed in writing, Nuvcreatives may display approved completed work in its portfolio, website, social media, presentations, case studies, award submissions, and promotional materials.

Confidential information, private business data, passwords, credentials, and sensitive client materials will not intentionally be displayed publicly.

Clients may request confidentiality before the project begins.

13. Third-Party Platforms and Services

Projects may rely on third-party services such as website platforms, hosting providers, domain registrars, Stripe, email platforms, analytics tools, plugins, applications, AI tools, or other external technology.

Nuvcreatives is not responsible for outages, policy changes, pricing changes, service interruptions, security incidents, platform limitations, or other issues caused by third-party providers.

Any ongoing third-party subscription, licensing, hosting, domain, software, or transaction fees are the client's responsibility unless specifically included in writing.

14. Website Launch and Technical Responsibility

For website projects, the client is responsible for reviewing and approving the website before final launch.

After final approval and handoff, ongoing maintenance, updates, platform subscriptions, hosting, domain renewals, plugin subscriptions, security monitoring, and future changes are the client's responsibility unless ongoing support has been purchased separately.

15. Results and Performance

Nuvcreatives provides strategic, creative, branding, website, marketing, and digital services intended to improve the client's business presence and customer experience.

However, specific revenue, traffic, conversion, ranking, sales, engagement, growth, or business outcomes cannot be guaranteed.

Results may depend on many factors outside Nuvcreatives' control.

16. AI-Assisted Work

Nuvcreatives may use professional AI-assisted tools as part of research, ideation, content development, design workflows, automation, production, analysis, or internal efficiency.

Final client-facing work remains subject to Nuvcreatives review, refinement, and quality control.

Clients should not provide highly sensitive credentials, regulated information, or confidential data unless specifically requested through an approved secure process.

17. Confidentiality

Nuvcreatives will use reasonable care when handling confidential project information provided by the client.

The client is also responsible for protecting passwords, credentials, private links, and account access.

Passwords and sensitive credentials should not be stored in general project notes or unsecured shared documents.

18. Client Approval

Client approval may be provided through email, project portals, review tools, payment, written confirmation, or other documented communication.

Once a phase or deliverable has been approved, material changes requested afterward may be treated as additional work.

19. Communication

Project communication should take place through the communication channels established for the engagement.

Important approvals, scope changes, payment decisions, and final decisions should be documented in writing.

20. Limitation of Responsibility

Nuvcreatives will perform services with reasonable professional care consistent with the agreed scope.

Nuvcreatives is not responsible for losses caused by inaccurate client-provided information, client delays, third-party services, unauthorized modifications after delivery, platform failures, misuse of delivered materials, or events outside reasonable control.

21. Acceptance of Terms

By checking the acceptance box at checkout, submitting payment, approving an invoice, authorizing work to begin, or otherwise proceeding with a Nuvcreatives service after receiving these terms, the client acknowledges that they have reviewed and accepted these Service Terms together with the specific scope and payment terms for their engagement.
